This Privacy Policy sets out how Pepper ("we", "us", "our") uses and protects any information that you give us when you use this website. Pepper is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, then it will only be used in accordance with this policy.

This policy applies to pepperconstruction.com. It does not apply to information collected offline, or on any third-party website we link to.

Information we collect

Information you give us

When you use the contact form on our site, we collect the reason for your enquiry, your name, the company you represent, the position you are interested in where relevant, your telephone number, your email address, your preferred method of contact, the office you wish to reach, and the services or areas you indicate an interest in.

• Job Applicants/Trade Partners: You may voluntarily provide data about yourself in connection with a job application or subcontractor prequalification form. Such provision of data is subject to the privacy policy of the third-party platform you use to submit your application.

• If you subscribe to our communications we collect your email address.

Information we collect automatically

When you visit the site we and our analytics provider automatically collect your IP address, approximate location derived from that address, the pages you view and the order you view them in, the time and duration of your visit, the referring page or search that brought you, and information about your device, browser and operating system.

We collect this information using cookies and similar technologies. Analytics cookies are set only if you consent to them.

Information from our email communications

If you receive email from us, we may use an embedded image to record whether you opened the message, and tagged links to record whether you clicked through to our site. You can stop this by unsubscribing, using the link in any message.

Information from other sources

We may receive information about you from our affiliates, from joint venture partners, from clients and trade partners in the course of a project, and from publicly available sources

• process and evaluate job applications and trade-partner prequalification submissions;

• understand how the site is used, and improve its content and performance;
• maintain internal records and administer our business;
• protect the security and integrity of our systems, investigate suspected misuse, and prevent fraud;
• comply with law and to establish, exercise or defend legal claims.

We do not use personal information for automated decision-making that produces legal or similarly significant effects about you.

Legal bases (visitors in the EEA and the UK)

Where the GDPR or UK GDPR applies, we rely on the following bases: your consent, for analytics cookies and for marketing email; the performance of a contract, or steps towards one, when you engage with us about a project, a role or prequalification; our legitimate interests in operating, securing and improving our business and our website, where those interests are not overridden by your rights; and compliance with a legal obligation.

Where we rely on consent, you may withdraw it at any time, and withdrawing it does not affect the lawfulness of processing carried out beforehand.

How we disclose information

Vendors. We may share the personal information you provide to us with other companies we have hired to provide services for Pepper ("Vendors"). Our Vendors are contractually bound to use your personal information only to perform the services we have hired them to provide. Pepper does not distribute, sell, or lease information about you to any third party or vendor.

Affiliates. We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include any Pepper company, joint venture partners, or other companies that we control or that are under common control with us.

By Law or to Protect Rights. If we believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation. This includes exchanging information with other entities for fraud protection and credit risk reduction.

Business transfers. In connection with a merger, acquisition, financing or sale of assets, subject to appropriate confidentiality protections.

Sale and sharing of personal information

We do not sell personal information for money.

We have not sold or shared personal information in the preceding twelve months, and we do not knowingly sell or share the personal information of anyone under sixteen.

Retention

We keep personal information only as long as we need it for the purposes described above, and then delete it or render it no longer associated with you.

Security

We are committed to ensuring that your information is secure. To prevent unauthorized access or disclosure,we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. No system is completely secure, so we cannot guarantee absolute security, but we review our safeguards and respond to incidents in line with our obligations.

International transfers

We are based in the United States and information we collect is processed there. Our analytics provider also processes information in the United States. If you are in the EEA or the UK, this means your information is transferred outside your home jurisdiction.

Links to Other Websites

Our site links to other websites, including our profiles on social media platforms and the third-party platforms we use for job applications and trade-partner prequalification. Those services are controlled by others and have their own privacy practices, which we do not control and are not responsible for. Review their policies before providing information.

• delete personal information we have collected from you;
• correct inaccurate personal information we hold about you;

We will not deny you goods or services, charge different prices, or provide a different level of quality because you exercised a right.

Notice to California job applicants, employees and contractors

If you apply for a role with us, or work for us as an employee or contractor, we collect and use personal information about you for recruitment, employment administration, benefits, payroll, safety, security and legal compliance. Categories, retention and rights for that information are described in our internal HR documentation.

How to submit a request

Submit a request by emailing info@pepperconstruction.com, or by writing to us at 643 North Orleans Street, Chicago, IL 60654-3608. To protect your information we will ask you to provide enough detail to verify your identity, and we will only use what you give us for that purpose. We will acknowledge your request within ten business days and respond substantively within forty-five calendar days, extending once by a further forty-five days where necessary and telling you if we do.
An authorized agent may submit a request on your behalf if they provide written permission signed by you, and we may still ask you to verify your own identity directly.

Opt-out preference signals

We treat a Global Privacy Control signal from your browser as a valid request to opt out of the sale or sharing of personal information, and we process it automatically for that browser without requiring you to confirm.

Other United States privacy rights

Residents of other states with comprehensive privacy laws may have comparable rights to access, correct, delete and obtain a copy of their personal information, and to opt out of targeted advertising, the sale of personal information, and certain profiling. We honor these rights where they apply to us.

Notice to individuals in the EEA and the UK

If you are located in the European Economic Area or the United Kingdom, this section describes the rights available to you under the EU General Data Protection Regulation and the UK GDPR. It supplements the rest of this policy, including the legal bases described above and the transfer information below.

Pepper, as described at the beginning of this policy, decides the purposes and means of the processing described here and is therefore responsible for it. Contact details are in the Contact Us section at the end of this policy.

Subject to the conditions and exceptions in applicable law, you have the right to:

• access the personal information we hold about you and obtain a copy of it;
• correct personal information that is inaccurate or incomplete;
• erase personal information where there is no continuing basis for us to hold it;
• restrict our processing of your personal information in certain circumstances;
• object to processing that we carry out on the basis of our legitimate interests, and to object at any time to processing for direct marketing purposes;
• receive the personal information you provided to us in a portable, machine-readable form, and ask us to transmit it to another organisation where technically feasible;
• withdraw your consent at any time where we rely on consent, including for analytics and for marketing email.

Withdrawing consent does not affect the lawfulness of any processing carried out before you withdrew it.

To exercise any of these rights, use the contact route in the Contact Us section. We may ask for information to confirm your identity before we act, and we will use anything you provide for that purpose only. We will respond within one month of receiving your request. If your request is complex, or if you have made several requests, we may extend that period by up to two further months and will tell you if we do.

You also have the right to lodge a complaint with a data protection supervisory authority. In the United Kingdom that is the Information Commissioner's Office. In the EEA it is the authority for the country where you live or work, or where you believe the issue arose. We would welcome the chance to address your concern directly first.

Children

The site is intended for a professional audience and is not directed to children. We do not knowingly collect personal information from children under sixteen. If you believe a child has given us personal information, contact us and we will delete it.

We may occasionally update this Privacy Policy. We will post any changes on this Web page, so be sure to check back periodically. If we make substantive changes, we will post a notice on our home page that the Privacy Policy has been modified and provide a link to the revised Privacy Policy.
